Never worth “doing time” for something like that. They will rip him in court. A knife attack by the little girl is an example of what would be justified to use that level of force in a court of law. The only time that “doing time” is worth the risk, is if your loved ones and/or yourself is in imminent danger of death or severe bodily harm. Remember, the court must be convinced that your perceptions were real and not an excuse. That itself is a crap shoot.
IMO, it’s straight up logical fallacy to say it was a “disproportionate response” the standard in which this is established needs a revision.
So, let me get this straight, say if some 300 lb dude that’s 6’4” shoved me and decides to relentlessly assault/taunt me, and knowing that I got no chance in hell, why would I opt for an option of retaliation that still leaves a good chance for him to become even more feral and amp up his attack? Point is, It simply isn’t human nature to respond PROPORTIONATELY in a situation where you’re being ganged up on and you feel threatened. You’re are GOING to make the decision that you BELIEVE will put an end to that escalation, “Dispropornate” or not.

The optics of her being knocked flat in response to heckling and pushing and shoving are terrible for his impending legal issues. 911 would have perhaps been of no practical use. Would it have been better to sustain clawing and scratching, get that captured on video so he could press assault charges?, vs him getting locked him? Very tough deal.

We don’t see what was going on except for a very limited view. A court will hear everything from the start to the last few seconds that was captured in the video. True, that was a big man versus a much smaller, younger girl but when she stepped to him with her hands up like that, he was justified in repelling the attack, and he didn’t continue assaulting her with kicking/stomping. I wonder if the tables were turned, if she had managed to knock him out or if one of her friends did, if the attack would have continued like they typically do in situations on the street like that.I wish there was more background on that story.
Fascinating how quick people are to come to the decision of a disproportionate response. And that’s the same problem with this being analyzed in the comfort of a court room with armed bailiffs and court decorum protecting the jury from violence. I don’t know the full context. It would be fascinating to learn the background criminal history on some of these kids in the video. This is a video of seconds where the man is surrounded by a pack of wild kids. The video shows how obviously none of the kids cared about authority and they thought they had complete control without repercussion. How is he to know he wasn’t going to be knifed in the back if he kept playing patty cake with the girl or if someone was going to play knockout game with his wife? I do think based on what I saw the safer course of action would be to direct the family through the pack and if they try to stop it be forceful in the escape. But I don’t know the context of the event, was not jacked with adrenaline in fight or flight mode, and did not have my family threatened. Did they really think they could surround and push an adult around with no recourse?
